For the first time the court has ruled on an illegal sex establishment in the municipality of ‘Haarlemmermeer’.
Once again is found that sexual services are performed by ‘Diamant Massage’ in Hoofddorp, the massage parlor will have to pay a penalty of € 10,000, that’s the decision of the court of the province of Noord-Holland.
The ruling represents a legal victory for the municipality of Haarlemmermeer.
Mayor Theo Weterings had already imposed this massagesalon a penalty. Sexual service was made for payment in the massage parlor. This requires, however, a licence, the massage parlor does not have one, and thus acts contrary to the law. So they had to stop their sexual services.
Thai massage parlor ‘Diamond’ did not agree with the decision of the mayor and has objected to, which was subsequently declared unfounded.
The judicial process of the owner finally yielded the support of the court for the decision of the Mayor
The decision of the mayor is based on two official reports of the police, on ads and messages on internet sites, including hookers.nl
At a traffic control is also stated that the condoms and lingerie sawn by a cop in the car, were intended for the personnel of the massage parlor.
Also, there are incriminating statements made by people who were present at the time of the control action in the massage parlor.
The company has also placed ads in the “Erotic” in Dutch newspaper ‘De Telegraaf’, there are also many reviews found on internet forums, where exit shows that the customers of the massage parlor can go there for various sexual services.
The owner of Diamond denies this and insists that there only Thai traditional massages are provided in his business.
The court thus agreed with the mayor. The mayor may rely on the accuracy of a report from the police. The company has not demonstrated that the statements of the police officers are incorrect. Also, the court holds that the massage parlor with an advertisement in the ‘Adult’ De Telegraaf, clients can expect eroticism.
The mayor has that rightly seen as important clue, says the judge. The same also applies to the reviews on the internet.
Mayor Theo Weterings is satisfied with the statement: “The judge sets the signal that we want to give extra strength to. This signal is: in Haarlemmermeer, no illegal sex establishments are tolerated. We explain hefty penalties and will check frequently.
Appeal against the judgment is possible to the Council of State.
